End-User License Agreement (EULA) for LMS

This End-User License Agreement ("EULA") is a legal agreement between you ("User," "you," or "your") and George Hall Tuition ("we," "us," or "our") governing your use of the LMS application ("LMS" or "App") provided for educational purposes. By accessing or using LMS, you agree to be bound by the terms of this EULA.
1. License Grant
George Hall Tuition grants you a limited, non-exclusive, non-transferable license to use LMS solely for educational purposes in conjunction with your tutoring services. This license is provided under the conditions of this EULA and may be revoked for misuse or non-compliance with these terms.
2. Acceptable Use Policy
To maintain a safe and respectful learning environment, you agree to:
- Respect Privacy: Safeguard your own and others' personal information. Refrain from sharing or distributing personal or sensitive data of other users.
- No Tampering: Any form of tampering with or alteration of Microsoft 365 or its associated features integrated with LMS is strictly prohibited.
- Responsible Conduct: Use LMS responsibly, without disrupting its functionality or degrading its performance, and adhere to all applicable laws and regulations.
- Authorized Communications: You may only use LMS and StudentMail to communicate with George Hall Tuition staff. Failure to comply may result in revocation of access to LMS or termination of tuition services.
3. Activity Tracking and Consent
LMS is tab-tracked to monitor usage. This includes logging of IP addresses, device information, tab recordings of clicks and activity timestamps within LMS. This tracking applies solely to LMS usage, and no other system tabs are recorded. By using LMS, you consent to this tracking and monitoring.
4. Technical Requirements
To ensure a smooth experience with LMS, it is your responsibility to:
- PDF Viewer: Have a compatible PDF viewer installed on your device to access PDF materials provided during tutoring sessions.
- DOCX Viewer: Ensure you have a DOCX viewer, such as Microsoft Office or WPS Office, installed for viewing and editing documents shared through LMS.
- Anti-Virus Software: We strongly recommend installing and maintaining up-to-date antivirus software on your device. While George Hall Tuition takes precautions to minimize potential security threats, we cannot guarantee complete protection against all risks.
5. Email Communications
All official communications from George Hall Tuition, including updates, assignments, and notifications, will be sent to your StudentMail email address, which is accessible via Outlook. You are responsible for checking this email regularly to stay informed.
6. Data Collection and Cookies
Our partners, including IONOS, OVH, Microsoft, Google, Statcounter, Hotjar, Woopra, SmartLook, Apple, Clicky, and HubSpot, may use cookies to collect and analyze data on LMS performance and usage. Embedded services, such as VideoJS, Spotify, Word Online, and YouTube, may also collect and use cookies. By using LMS and related services, you consent to this data collection.
7. Limitation of Liability
While George Hall Tuition endeavors to maintain the App’s functionality and security, we do not guarantee uninterrupted access, virus-free operation, or that LMS will always meet specific performance expectations. George Hall Tuition will not be liable for any data loss, technical issues, or security breaches that may arise. Use of LMS is at your own risk.
8. Updates and Modifications
George Hall Tuition reserves the right to modify, update, or discontinue LMS at any time, with or without prior notice. Continued use of LMS following an update or modification implies your agreement to the updated terms.
9. Termination
George Hall Tuition reserves the right to terminate or suspend your access to LMS for any violations of this EULA. Upon termination, all rights and licenses granted to you under this EULA will immediately cease.
10. Governing Law
This EULA is governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from this EULA shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
By using LMS, you acknowledge that you have read, understood, and agree to this EULA in full.
